improve handling of empty parts #491

According to this comment:
#198 (comment)
when there are empty parts (after migration) there will be warning message printed and, depending on what operations follow, a crash.

We should review the code, add tests, and handle the existence of empty parts so that we error/throw before a crash occurs.
